Lindsay Lohan Considering Plea Deal

Reality just might be sinking into Lindsay Lohan’s head, as she’s apparently ready to accept a plea deal in her jewelry theft case. TMZ reports that lawyers for Lohan and prosecutors for the state of California are hammering out a deal that would put Lohan back behind bars – but only under her terms. Deputy District Attorney Danette Meyers is dead-set on a six-month jail term she deserves, and that’s led Lohan’s lawyer Shawn Chapman Holley to book a meeting with the judge for next week to do a little negotiating and will ask Judge Schwartz what sort of sentence he’d give Lohan if she took a plea bargain.

Sources familiar with the case and Judge Schwartz believe His Honor would probably go for a three-month sentence.

Our sources say both Meyers and Holley believe Lindsay will only do 20% of the actual sentence because of overcrowding. So, if Judge Schwartz gave Lindsay three months, she’d only serve 18 days.

How is over-crowing even an issue? Doesn’t seem to be a problem when us regular folks do some stupid shizz. Judge Schwartz has warned Lohan – who is free on $40,000 bail – if she pleads guilty or no contest to the charge then she would do jail time and that he could rule that she is in violation of her earlier DUI order. Lohan must decide whether to accept the deal or plead not guilty and take the case to trial by the time of her next hearing, which has been set for March 10th. Sixth mugshot, coming up!

Lindsay Lohan’s First Post Rehab Interview – Video

Lindsay Lohan wants to get her career back into gear. She just got a new agent and is on the hunt for new movie roles. March 10th she’ll be back in court to face the Judge and her felony grand theft charge. If found guilty she could spend up to 3 years in state prison. If she accepts a plea deal and pleads guilty or no contest she will still face jail time because of a violation of her probation. But lucky for us, Lindsay’s sitting down with ‘Extra‘ for her first interview since getting out of rehab.

Per Fox News:

“I feel great. I feel happy,” a lucid and relaxed Lindsay Lohan told Extra’s Jerry Penacoli. “There are always going to be bumps that we have in the road, but as long as I’m focusing on the one thing that I know that I need to put first in my life—which is my recovery and stuff. I’m doing good, and that’s what’s most important to me.”

Wow. The eye-roll about her “recovery” (she can hardly say that word without gagging) is very telling. Lindsay also says she’s keen to start working again but accepts she’s got a lot to prove before anyone will want her involved in a movie project again.

“I think that’s that something I will be able to say when I’ve taken the steps I need to take to prove that I can be insurable again. I think that will come in time that I will be in the position to say that because I don’t think I am right now. I don’t think it would be fair to say, ‘Oh, this is who I want to work with’, and expect that to happen. I have to build my way back up and I get that.”

But you see Ms. Lohan, everyone has lost all respect for you. There are too many talented actresses out there with something you do not have… ethics.

Lindsay Lohan’s Jewelry Theft Surveillance Video Details

Remember how Lindsay Lohan wasn’t ready to accept a plea deal in court yesterday, instead preferring to wait for her lawyer to check if the surveillance video vindicated her? Yeah, well she might want to rethink that! Lindsay claimed that her stylist was the one who “forgot” to return that necklace, but sources say the jewelry store surveillance video clearly shows her stealing it. According to RadarOnline.com, a male friend of LiLo’s allegedly “distracted the clerk on purpose” while she put the necklace on and later walked out of the store with it.

“Lindsay had removed a necklace of hers that she was wearing when she tried on the necklace in question,” the source close to the case told RadarOnline.com, exclusively. “As Lindsay was putting her necklace back on, it’s apparent the store clerk was distracted by the male companion that was with Lindsay.”

The sales associate provided a statement to investigators claiming she didn’t realize that Lohan hadn’t taken the necklace off, RadarOnline.com has learned.

“The video then shows Lindsay and her male friend walking out of the store, all while Lindsay was wearing the necklace,” said the source. “It’s all clearly visible on the video.”

Yesterday, Lindsay entered a plea of not guilty to one count of felony grand theft. Should the video prove to be as damning as some who have seen it are claiming (one even called it a ‘smoking gun’) she could be facing three years in jail.

“The District Attorney believes that Lindsay’s friend distracted the clerk on purpose and that could bolster the case if it goes to trial against Lindsay,” said the source. “This simply wasn’t a case of miscommunication of a necklace being loaned and not returned, as Lindsay has claimed.”

Lindsay’s next court date is March 10th. If she still refuses a deal the case will go before another Judge for a preliminary hearing, and then go to trial. Whether she wants to or not it would be in Lindsay’s best interest to just suck it up and take the plea because chances are she’s gonna wind up behind bars either way. Even if Lindsay is somehow exonerated at trial, she’ll still be in jail for the probation violation. Not looking too good for Ms. Lohan either way you look at it.

Judge Tells Lindsay Lohan ‘You WILL Go to Jail’

Lindsay Lohan was back in court this morning in LA, facing the Judge to determine if there would be a formal hearing for her felony grand theft charge. Lindsay was charged after she allegedly stole a necklace from a Venice Beach jewelry store. It was rumored that Lindsay might possibly take a plea bargain today – if there was no jail time included in that bargain – but things didn’t go exactly as she planned, as Deputy D.A. Danette Meyers reportedly wanted her in jail for six months. The judge addressed Lindsay and made it very clear that she will be treated like everyone else, and that he isn’t going to give her special consideration because she’s a celebrity. He promised her that if the case was resolved in his courtroom she would be going to jail.

Per TMZ:

Judge Keith Schwartz told the famous defendant bluntly, “I don’t care that you’re Lindsay Lohan.” Judge Schwartz did not say how much jail time Lindsay would do if she cops a plea. And, Judge Schwartz wants a psychological evaluation that will help him understand what makes Lindsay tick and what particular sentence is appropriate. The judge explained … if Lindsay pleads guilty or no contest, it will be an automatic admission she violated her probation.

Lindsay’s lawyer Shawn Chapman Holley asked for more time to review the jewelry store surveillance video she just received today. So Lindsay will be back in court again on March 10th. At that point, she’ll either accept a plea and go to jail or she’ll stand trial and if she’s found guilty she could get 1 year in state prison. So it looks like anyway you slice it, Lindsay’s going to be back behind bars. My question is: Why isn’t she in jail already? Enough is enough!

Lindsay Lohan’s Outfit Causes Courtroom Controversy

She may have been told not to push her luck by the judge, but everyone tonight isn’t talking about the courtroom drama surrounding Lindsay Lohan. Rather, they’re talking about what was barely surrounding her ass-her choice of outfit!

Lohan showed up to court today in a pure white Kimberly Ovitz frock, with a hem-line located just below her fire crotch.

Lindsay Lohan wanted to make a statement during her arraignment today — a fashion statement — and consciously chose her solid WHITE dress to symbolize her innocence .

Lindsay Lohan Arraigned in Court, Told “Don’t Push Your Luck” by Judge

After a small delay while lawyer Shawn Chapman-Holley and prosecutor Deputy District Attorney Danette Myers met in Judge Schwartz’s chambers, Lindsay Lohan has been officially charged with felony grand theft for stealing a $2,500 necklace. The felony complaint alleges that Lohan “did unlawfully take money and personal property.” Lohan plead not guilty and waived her right to a preliminary hearing in 10 days – instead, all parties will be back on Feb 23rd “to attempt to resolve the case.” If ultimately convicted, she could face a maximum sentence of three years in prison.

Per TMZ:

Lindsay Lohan was just remanded into custody — following a STRONG warning from Judge Keith Schwartz — “You’re no different than anyone else … please don’t push your luck.” Judge Schwartz set her bail at $20,000 — but warned, “If you violate the law, I will remand you and there will be NO BAIL.”

Myers asked the judge to revoke Lohan’s current probation, which was granted, and bail was set at $20,000 on that as well. Lohan and her agents were also ordered to have no contact with the jewelry store or the owners after Meyers said someone had sent the store owners flowers which freaked them out. Lohan is currently in custody and being booked.

Lindsay Lohan Ordered To Stay In Rehab – NO Jailtime

Lindsay Lohan caught a lucky break this morning – Judge Elden Fox ordered Lohan to stay in rehab until January 3rd, 2011 instead of sending her to jail for violating her probation. She is due back in court on February 25th and will have to undergo random drug and alcohol testing between her release from rehab until her court date. She will also reportedly have her SCRAM bracelet removed today.

Per TMZ:

The said to Lindsay at one point, “You are an addict. I hope you understand that.” Lindsay nodded her head in agreement.

The D.A. reportedly suggested 6 months in jail for Lindsay while the probation department recommend 1 month in jail. Lindsay was said to be in tears at the end of the hearing and simply told the judge “thank you” for choosing rehab over jail.

Early Release For Lindsay Lohan?

Lindsay Lohan will more than likely be a free woman sooner than expected! Lohan is currently being held at the UCLA Neuropsychiatric Hospital and doctors are saying that her psychiatric problem is not as serious as they first thought. According to TMZ, they were suspecting that the actress has a bipolar disorder but turned out that it wasn’t the case after all. Furthermore, the doctors added that her Adderall issues could be taken care of as an outpatient case.

Bottom line … sources say it’s “very possible” Lindsay is getting out this week and will begin getting outpatient care.

Once Lohans’ doctors write their final report mentioning that they believe her to be fine, her lawyer Shawn Chapman Holley can go back into court and request the judge to allow her client to receive outpatient care. TMZ reports that the court would be likely to approve her release if doctors gave her the green light to receive treatment at home.

Lohan checked into the rehab center on August 2nd, after serving only 13 days of a three-month sentence in a Los Angeles county jail. She was originally set to begin her rehab program at the Morningside Recovery center in Newport Beach, California, but the judge in her case, Marsha Revel, ordered a last-minute switch to the UCLA facility for what were described as security reasons. Earlier last week, Revel removed herself from the case (read about that here.) When Lohan is indeed released, she will be subjected to random drug and alcohol testing and could be jail-bound once again if she is caught violating again.

So, in other words, her horrid behavior can’t be pinned on mental illness or even drug abuse. Final diagnosis? Spoiled Bratitus.

Lindsay Lohan Tells Judge ‘F**k You!’ – PHOTOS

We all may be wanting to buy Judge Marsha a big ol’ drank and carry her around on throne built out of SCRAM bracelets while 12 virgins throw Hermes scarves into the air and Balki Bartokomous does the dance of joy, but Lindsay is super angry.

While Lindsay Lohan was at her probation violation hearing and begged the judge to believe that she wasn’t a coke snorlax, hasn’t had a drop of booze and understands the levity of the situation…Lohan had ‘F**K U” written on her fingernail that she flashed at the judge several times.

Lindsay Lohan Sentenced To JAIL!!! – VIDEO

Judge Marsha Revel has ruled that Lindsay Lohan violated the terms of her probation in a drunk driving case when she failed to attend alcohol education classes and sentenced her to 90 days in jail.

Per TMZ:

The evidence was loud and clear today — Lindsay violated probation by failing to attend her alcohol ed classes based on the schedule set by the judge. There were lots of excuses, but ultimately they didn’t fly.

Lindsay broke down as she addressed the court, telling the judge, “I did the best I could.”

Judge Revel stated several instances over the last few years in which Lohan lied about taking drugs and drinking. Prosecutors failed to comply with the weekly attendance directive for her alcohol education classes. An operator of the class testified that Lohan had nine absences.

In considering her punishment, Revel said she considered whether Lohan violated her probation only for the actress’ failure to attend some scheduled alcohol education classes, not because the alcohol-detection bracelet that Lohan was ordered to wear had been triggered following the MTV Movie Awards (read about that here.) Following her 90 day stint in jail, Lohan has two days to surrender herself for another 90 days to an inpatient rehab center. Lohan must surrender on July 20th at 8:30am in Judge Revel’s court.
