Lindsay Lohan Considering Plea Deal

Reality just might be sinking into Lindsay Lohan’s head, as she’s apparently ready to accept a plea deal in her jewelry theft case. TMZ reports that lawyers for Lohan and prosecutors for the state of California are hammering out a deal that would put Lohan back behind bars – but only under her terms. Deputy District Attorney Danette Meyers is dead-set on a six-month jail term she deserves, and that’s led Lohan’s lawyer Shawn Chapman Holley to book a meeting with the judge for next week to do a little negotiating and will ask Judge Schwartz what sort of sentence he’d give Lohan if she took a plea bargain.

Sources familiar with the case and Judge Schwartz believe His Honor would probably go for a three-month sentence.

Our sources say both Meyers and Holley believe Lindsay will only do 20% of the actual sentence because of overcrowding. So, if Judge Schwartz gave Lindsay three months, she’d only serve 18 days.

How is over-crowing even an issue? Doesn’t seem to be a problem when us regular folks do some stupid shizz. Judge Schwartz has warned Lohan – who is free on $40,000 bail – if she pleads guilty or no contest to the charge then she would do jail time and that he could rule that she is in violation of her earlier DUI order. Lohan must decide whether to accept the deal or plead not guilty and take the case to trial by the time of her next hearing, which has been set for March 10th. Sixth mugshot, coming up!

Judge Tells Lindsay Lohan ‘You WILL Go to Jail’

Lindsay Lohan was back in court this morning in LA, facing the Judge to determine if there would be a formal hearing for her felony grand theft charge. Lindsay was charged after she allegedly stole a necklace from a Venice Beach jewelry store. It was rumored that Lindsay might possibly take a plea bargain today – if there was no jail time included in that bargain – but things didn’t go exactly as she planned, as Deputy D.A. Danette Meyers reportedly wanted her in jail for six months. The judge addressed Lindsay and made it very clear that she will be treated like everyone else, and that he isn’t going to give her special consideration because she’s a celebrity. He promised her that if the case was resolved in his courtroom she would be going to jail.

Per TMZ:

Judge Keith Schwartz told the famous defendant bluntly, “I don’t care that you’re Lindsay Lohan.” Judge Schwartz did not say how much jail time Lindsay would do if she cops a plea. And, Judge Schwartz wants a psychological evaluation that will help him understand what makes Lindsay tick and what particular sentence is appropriate. The judge explained … if Lindsay pleads guilty or no contest, it will be an automatic admission she violated her probation.

Lindsay’s lawyer Shawn Chapman Holley asked for more time to review the jewelry store surveillance video she just received today. So Lindsay will be back in court again on March 10th. At that point, she’ll either accept a plea and go to jail or she’ll stand trial and if she’s found guilty she could get 1 year in state prison. So it looks like anyway you slice it, Lindsay’s going to be back behind bars. My question is: Why isn’t she in jail already? Enough is enough!

Lindsay Lohan Arraigned in Court, Told “Don’t Push Your Luck” by Judge

After a small delay while lawyer Shawn Chapman-Holley and prosecutor Deputy District Attorney Danette Myers met in Judge Schwartz’s chambers, Lindsay Lohan has been officially charged with felony grand theft for stealing a $2,500 necklace. The felony complaint alleges that Lohan “did unlawfully take money and personal property.” Lohan plead not guilty and waived her right to a preliminary hearing in 10 days – instead, all parties will be back on Feb 23rd “to attempt to resolve the case.” If ultimately convicted, she could face a maximum sentence of three years in prison.

Per TMZ:

Lindsay Lohan was just remanded into custody — following a STRONG warning from Judge Keith Schwartz — “You’re no different than anyone else … please don’t push your luck.” Judge Schwartz set her bail at $20,000 — but warned, “If you violate the law, I will remand you and there will be NO BAIL.”

Myers asked the judge to revoke Lohan’s current probation, which was granted, and bail was set at $20,000 on that as well. Lohan and her agents were also ordered to have no contact with the jewelry store or the owners after Meyers said someone had sent the store owners flowers which freaked them out. Lohan is currently in custody and being booked.

Lindsay Lohan WILL Bail Out Of Jail Within A Few Hours

They don’t call it “Celebrity Justice” for no good reason! Lindsay Lohan WILL be a free woman – yet again – within the matter of hours after her attorney Shawn Chapman Holley filed an appeal Friday afternoon, arguing Lohan was unlawfully denied bail. So much for her being prepared to take “responsibility for my actions” and being “prepared to face the consequences.”

Per TMZ:

Judge Fox ruled earlier today … Lindsay could be held without bail. But apparently the Judge’s ruling flies in the face of California law, which gives defendants the right to bail in misdemeanor cases. Judge Patricia Schnegg, Assistant Supervising Judge for the L.A. County Criminal Courts, just threw Judge Fox’s bail decision out the window. Judge Schnegg has set bail at $300,000.

Lohan will be required to be fitted for yet another SCRAM bracelet – her third, for those keeping count – to ensure that she stays clean and sober for the next month until her probation hearing on October 22nd. She is also not allowed to socialize with any known drug users, and must be willing to submit to a law-enforcement search at any time. In addition, Lohan will not be allowed to spend her nights at any clubs or establishments where alcoholic beverages are the main seller.

And there you have it. Celebrity preferential treatment at it’s best. Lindsay must be feeling like she can get away with anything now.

Lindsay Lohan Could Be Released From Rehab Today

Despite receiving a 90-day rehab sentence handed down to her by Judge Marsha Revel, it seems quite possible that Lindsay Lohan could be leaving the UCLA Medical Center as early as today. Lohan’s lawyer, Shawn Chapman Holley, appeared in court yesterday to report that Lohan was misdiagnosed and wasn’t in the dire state that she was originally thought to be in. The new judge over case, Judge Elden Fox, is expected to issue an order sometime after 1:30pm PST, and it could be her ticket out, confirming recent rumors that she’ll be let out of rehab early.

Per TMZ:

Sources have told us they expect Lindsay’s release will probably come this week, to be followed by outpatient care. All signs point to Judge Fox executing this plan.

A big reason for that? They think treatment will be easier than expected as she’s hooked on Adderall to treat ADHD, which they say she really does not have, and that perhaps being improperly prescribed was her major problem, behavior-wise. If medical professionals’ opinions are that she should be released, the judge would have to really want to stick it to Lohan to override their recommendations.

What’s the point of judges sentencing people to a specific time behind bars or in rehab if another judge will just come along behind them and shake the etch a sketch and let the offender off? Only time will tell, but I predict that not very long after Lindsay is released, Dina will yet again be making excuses for her because I highly doubt she’s learned a lesson. She needs serious help. Instead she gets the powderpuff treatment.

As TMZ first reported, all signs are pointing to Lindsay Lohan being released from UCLA this week — and we’re hearing it will happen tomorrow. Judge Elden Fox has decided not to issue an order today, but rather he will make a decision tomorrow at 8:30 AM PT.

As we’ve told you, the doctors at UCLA think Judge Marsha Revel’s mandate that Lindsay spend 90 days in rehab is excessive, and they are recommending an early release.

Sources tell us going into last weekend, the plan was for a Wednesday release, and all signs now point to Judge Fox releasing Lindsay tomorrow morning and ordering outpatient care.

Lindsay Lohan Tests Negative For Alcohol

Lindsay Lohan seems to have caught another lucky break after her SCRAM bracelet went off earlier this month at an MTV Awards afterparty (read about that here.) Her court-ordered urine sample has come back as negative.

Per PopEater:

“They did a urinalysis through Medtox labs and it indicated conclusively that there was no alcohol in her system at that time,” a source told E! “She was ordered to go right in and today just got the report back and it was negative.”

So, how much did they pay the lab off? The DA’s office office previously said the alert was “an alcohol-related violation.” It remains unclear what triggered the device, although her mother Dina Lohan has come up with a not-so-unique excuse blaming the incident on a partygoer who accidentally spilled their drink on her. Her lawyer, Shawn Chapman Holley, confirms the results yesterday as well and denies the possibility that Lohan could have tampered with the bracelet.

Lindsay’s alcohol level ranged from .03 to .04 from midnight to 3 a.m on June 6, during the hours after the MTV awards, RadarOnline.com is reporting. “There was absolutely no doubt that Lindsay was drinking, and the report that the alcohol monitoring service provided to Judge Revel was very detailed and extremely reliable,” a source close to the situation told RadarOnline.com.

“The (SCRAM) report also says that Lohan’s SCRAM bracelet had indeed been tampered with, and this is one of the reasons that Judge Revel determined that Lindsay violated terns of her bail,” the source told RadarOnline.com.

Sources connected with the Probation Department say the test results are good enough for them and as far as they are concerned Lohan is in full compliance with her probation.

Despite reports that the probation department has cleared Lindsay, the judge in her case has not and that is the biggest hurdle for the actress. The source told RadarOnline.com that Lindsay’s urine test will not be accepted as gospel, due to the reliability of the SCRAM device.

Lohan remains free on $200,000 bail and is still subjected to weekly random drug testing. It’s also looking like Lindsay will be in full compliance with her alcohol ed classes by the next court hearing, scheduled for July 6th. Either way, she gets another free pass – as usual.

Lindsay Lohan Headed To Jail

Things have gone from bad to worse for Lindsay Lohan, who reportedly has violated the terms of her probation and has to head back to court next month to face the judge and will most likely have to serve time in the slammer. Lindsay was placed on three years’ probation and ordered to complete an alcohol rehabilitation program after pleading guilty to cocaine use and driving under the influence in August 2007, but has not yet completed the alcohol education course the judge slapped on her. She should have attended the course once every 7 days, per judges orders, or gone into rehab but Lindsay has done neither which could see her behind bars.

Per TMZ:

Judge Marsha Revel made it clear to Lindsay late last year, she must attend alcohol ed courses once every 7 days. The only exception — if she was in inpatient rehab. And the judge was explicit … if Lindsay did not comply with the terms of probation, she was going to jail.

The school in which Lindsay enrolled is required by state law to inform the court only if the student is MIA for 21 days. So here’s the disconnect: The school has not reported an attendance violation … because Lindsay frequently waited until the 21st day to attend classes.

Bottom line — Lindsay met the school’s requirement, but squarely violated the judge’s order.

Judge Revel has made it clear to Lindsay — no more chances. If probation is violated, she’s going to jail … and probation was repeatedly violated.

Seriously – the girl can’t make one meeting a week? She has no work whatsoever! As a result, she is likely to face jail at a court progress hearing scheduled for May 20th on the grounds that she habitually violated the judge’s requirement. If the judge sticks to her word Lindsay is going to be in jail one way or another soon. Lohan’s lawyer, Shawn Chapman Holley, is denying she has a probation problem.

“We have received no negative written report from the program and contend Ms. Lohan is therefore in compliance.”

Guess that means no more nights out stumbling down and no more Twitter wars with ex Samantha Ronson. Maybe it would do Lindsay good to get a bit of perspective and some time away from the party scene. I say throw the book at her … and then throw away the key!
